Statutory Sick Pay

What is Statutory Sick Pay and who is entitled?

Any employee who is struck down by illness for four or more consecutive days may be entitled for up to 28 weeks of replacement salary at £85.85 per week (£86.70 2013/14) providing they meet certain requirements.

For any illness that prevents your employee working for seven days a statement of fitness for work needs to be provided, this will ascertain whether a doctor/hospital deems them fit for work or unfit for work, and may provide suggestions to alleviate your employee’s workload.

What are the conditions an employee needs to meet?

Initially a claimant must be recognised as an employee and not a worker, be sure to verify the difference if you’re uncertain! Agency workers however do qualify.

They need to have conducted some work for you (could just be one day) and be earning a minimum of £109 a week before tax in order to be eligible. They are required to notify you within 7 days of their desired payment start or your own contracted limits.

Payment:

During the first 3 days of the qualifying period the employee is exempt from receiving payment, but on the 4th day you can start the payments of £85.85 or £86.70 depending on the tax year.

What are the exceptions that prevent employees claiming?

An employee is prohibited from claiming SSP if they prove prone to illness and have already received the maximum allotted 28 weeks, or have taken 3 years or more ‘linked periods’ of sickness, in which 4 or more days of sickness happen within 8 weeks of each other.

An employee is exempt from sick pay if they are receiving Maternity Pay and there are additional pay rates for anyone working in the agricultural industry.

If you don’t think an employee qualifies for SSP you must return a SSP1 form within 7 days of your employee’s sickness.

Notice:

If you have an alternative contract regarding Sickness Pay you need to ensure that your employee is aware of the notice period etc. after a month of employment.
